TERMS AND CONDITIONS

 

PAYMENT TERMS:

Booking Deposit: 20%

Payment of the deposit confirms your order and acceptance of these terms and conditions.

The deposit is partially refundable providing at least 10 working days notice of cancellation has been provided.  Should cancellation occur a 20% administration fee & fees/expenses incurred in the preparation of the installation, eg network application fees, electrical engineering drawing expenses etc. will be deducted from the deposit amount and the balance refunded to the client.

Balance Payment = 80%

The balance of the supply amount is due prior to delivery of stock to site and prior to installation. Hardware remains the property of Photonix Energy until balance payment has been received.

 

Point of Sale Discount (POSD): 

A POSD is when the estimated eligible rebate for the pv system size purchased by the client is deducted from the total amount payable by the client and is to be made as a direct payment to Photonix Energy upon completion of the installation. 

If the client takes up the offer of a POSD they agree to:

 

  1. Provide full co-operation & not hinder in any way the completion, certification or documentation for renewable energy rebate applications as required by the Clean Energy Regulator (CER);
  2. Provide access to completed installation for inspection & sign off purposes & any system adjustments should they be required for final certification.;
  • Supply requested documentation to support rebate application;
  1. Sign rebate application authorizations when requested;
  2. To pay Photonix Energy the outstanding rebate amount should they not provide all requested documentation/authorizations within a prompt & reasonable amount of time.

 

Where a POSD is provided to the client the client agrees to the following payment terms:

 

Deposit: 20% of project pre rebate price

Payment of the deposit confirms your order and acceptance of these terms and conditions.

The deposit is fully refundable except in the following circumstances:

  • Cancellation occurs less than 7 working days prior to a confirmed
  • If a pre-application has been completed then the deposit less $500 will be refunded.

Progress Payment 2: 80% of after rebate price

The balance of the supply amount is due prior to delivery of stock to site and prior to installation. Hardware remains the property of Photonix Energy until balance payment has been received.

 

Final Balance:  Rebate Value

The client is liable for the rebate amount until such time as all documentation required from the System Owner has been supplied to Photonix Energy.

 

If Photonix Energy are prevented from submitting a claim for the rebate amount due to the property/system owner not allowing completion of works or not returning a signed STC Assignment Form then the final balance will be payable by said property/system owner immediately.

 

Incentives and Rebates

The value of STC incentives rebates are market driven and therefore variable. Receipt of deposit will secure the quoted value for a maximum rebate variation of 5%. Should the market value of the rebate drop by more than 5% prior to the system installation then the POSD value will be re-calculated and difference will be payable by the client.

 

Goods remain the property of Photonix Energy until payment is received in full

The rebate is not claimable until all certification requirements have been satisfied and proof provided. This is the client’s insurance that Photonix Energy will supply a legally compliant pv system

All STC incentives and any Federally funded rebates are to be remitted back to Photonix Energy on submission of required paperwork.

Component Certification:

All components comply with Australian Standards and are approved for rebates.

Installation

Photonix Energy provide an advisory, project management consultation, supply and installation service. We ONLY USE CEC ACCREDITED DESIGNERS AND INSTALLERS.

We maintain currency of all relevant insurances and warranties relating to workmanship and any components they may provide in completion of the works.

All liability for electrical works is held with the CEC Accredited installer.

Installation payment is due upon passing of inspection (indicated by issue of CES).

Warranties

All component warranties are with the manufacturing company.

All installation warranties are with the CEC Accredited installing electrician and their company.

Services fees to an accredited electrician required to attend a site for the purpose of testing/servicing/repairing a PV system are payable by the client

and are not included in the product warranty.

Photonix Energy can aid with servicing and warranty claims, but are not responsible for future care, maintenance & servicing.

 

 

Photonix Energy Obligations:

1.  Supply ASA approved equipment same as or equivalent to quote or invoice.  Product, regulation or network restriction changes may result in product  or design change. Photonix Energy will supply a solution of equal or better quality and production capability where possible or re-quote on an alternative.

2. Complete distributor pre-application requirements

3. Facilitate the appointment of an accredited and licensed electrical installer by the client.

4. Provide job specification and plan to the installing electrician.

5. Be available to the client to answer queries or help with any equipment issues which may arise.

6. Procurement of products.

7. Co-ordinate supply & installation.

8. Monitor progress of post install certification, documentation & notification requirements

9. Provide system manual to client

10. Collection of rebate documentation.

11. Ensure all relevant notifications have been sent to required parties, eg client’s electrical retailer has been notified and/or area distributor

 

 

Client Obligations:

1. Final system payment before installation commencement

2. Be available for design & product briefing with the installer on the day.

3. Seek confirmation of equipment & design from installer prior to works beginning.

4. Raise any concerns or queries relating to supplied equipment or system design immediately with the installer and/Photonix Energy. Failure to do so indicates acceptance of supplied system & voids any future claims

5. Provide safe, clean site access.

6. Sign & return STC Assignment Form in a timely manner when requested.

7. After install site access granted for independent electrical inspection so that Certificate of Electrical Safety can be signed

& off & validated.

8. Payment of all outstanding balances

Installer Responsibilities

1. Design & product confirmation with client

2. Install PV system to State/Australian regulation

3. Raise relevant State Certificate of Electrical Safety (CES)

 

 

 

 

                                                                                                                                                             

4. Arrange independent electrical inspection

5. Provide copy of approved CES to client & Photonix Energy

6. Provide client with verbal instructions on inverter & a copy of the operation manual

7. Provide client’s completed Electrical Works Request (EWR), PV Generator Connection Form (PVGC) & CES to Photonix Energy for on forwarding to relevant State authorities and electrical bodies.

9. Provide Photonix Energy with serial numbers & NMI and provide Project specific Operations Manual for client’s use and reference.

5:  Smart Meter Export Activation

 

Responsible Party:  Electricity retailer

Raises order to area Distributor.

 

 

Average Time:  10 working days after

receipt of notification (step 4)

3:  Rebate Application Completion

 

Responsible Parties: 

Photonix Energy to complete & collect all requirements for application.

 

System owner to ensure their signed authorization is completed when requested & any supporting documentation is supplied.

 

 

6:  Smart Meter Re-Configuration (if applicable)

 

Responsible Party:  Network distributor

 

Average Time: 10-20 working days after receipt of order from retailer

 

 

 

7:  Retailer FIT Agreement (if applicable)

 

Responsible Party:  Client

 

Average Time: 10 working days after retailer notification

 

 

8:  System Manual Supplied

 

Responsible Party:  installer supplied to Photonix Energy for perusal before supply to client

 

Average Time:  2-3 weeks after completion of all paperwork submissions

 

 

 

 

 

 

 

 Warranties & Warranty Process

If a system fault occurs first contact should be to the installing electrician to discuss the fault & book a service call if required. Notify our office by email or phone so we can be of assistance & monitor action taken.

 

 

Installer (or any accredited electrician) should perform an equipment test to determine problem & course of action required.

 

Follow manufacturer warranty procedure.

Photonix Energy can assist, but are not responsible for warranty claims.

 

The system owner is responsible for any costs incurred to facilitate a warranty, eg electrician’s service fee, freight charges.

 

Manufacturer product warranties do not cover the electrician’s/installer’s call out fee. Any fees incurred for service are payable by the system owner (as with any appliance servicing)

 

Payment of deposit is acknowledgement of your acceptance of these terms.

 

Property Damage

The Client agrees to and accepts our policy of “All care, no responsibility” with regards to property damage.

All person’s either employed by, contracted to or referred by Photonix Energy which require access to the property in order to complete pv works will take all reasonable care to avoid any damage, but will not be held responsible should unintentional damage be caused to either the building or surrounding grounds.

Whilst all contractors are fully insured for liability due to negligence,

The client accepts total responsibility for any repair works they deem necessary & agrees that they will not seek

reimbursement or damages costs from either Photonix Energy or any party entering the property in order to necessitate completion of works, certification, maintenance or at the request of the client for damages caused due to mitigating or other circumstances not declared to us or out of our control.

 

System Sizing

System size stated on Quote or invoice may be rounded up or down to nearest whole or 1/2 value.

Exact kW’s supplied is dependent on current standard panel wattages.

Continuous advancements in cell efficiency mean that physical panel sizes remain the eg a 4kW system using 16 x 260w panels will equal 4.16kw; a 10kW system using 38 x 260w will equal 9.88kW
